Confiscating NPS or controlled substances

Under current guidance, staff members are permitted to search students’ desks or lockers belonging to the school on suspicion of possession of illegal drugs although prior permission should be sought. Staff should not physically search a pupil or their personal belongings. Staff may ask the pupil to turn out their pockets or bags. If consent is refused the only option is for staff to call the Police to carry out the search. Any forced search by staff could be interpreted as an assault. The police have powers of search and will be able to assist. The SCPO will be able to offer advice and assistance. Teachers can confiscate, and dispose of any new psychoactive substances (NPS) that they find on school property, in line with school policy.
